Part 1 — Terms of Service
These Terms of Service (“Terms”) are a legal agreement between Alwize LLC (“Alwize,” “we,” “us,” or “our”) and you, the client (“Client,” “you,” or “your”). By purchasing a package, paying an invoice, or starting a project with us, you agree to these Terms.
1. Services
Alwize provides marketing and design services, which may include social media content, graphic design, website design and development, email marketing, and related creative work (the “Services”). The specific Services, deliverables, and price for your engagement are set out in your chosen package or a written proposal/invoice (“Order”). These Terms apply to that Order.
2. Our Process
- Much of our work is produced with the assistance of AI tools and reviewed by a human before delivery. By engaging us, you acknowledge and accept this method of production.
- We produce work based on the information, materials, and approvals you provide. The quality and timing of deliverables depends on you providing what we need on time.
3. Payment
Monthly subscription plans
- Fees are billed monthly in advance and are due on your billing date each month.
- Your subscription renews automatically each month until cancelled (see Section 8).
- A one-time onboarding fee may apply as stated in your Order.
Per-project work
- Unless otherwise agreed, 50% of the project fee is due upfront before work begins, and the remaining 50% is due before final files are delivered.
All plans
- Payment is due within 7 days of the invoice date.
- Late payments may result in paused or suspended work until the balance is paid.
- All fees are non-refundable except as expressly stated in these Terms or required by law.
- You are responsible for any chargeback or dispute fees on payments you later reverse without cause.
4. Client Responsibilities
You agree to:
- Provide accurate information, content, images, and brand materials needed for the work.
- Respond to requests for approval or feedback in a reasonable timeframe. Extended delays (e.g. more than 14 days without a response) may pause your project or forfeit a billing period without refund.
- Ensure you have the legal right to use any materials you provide to us (logos, photos, text, fonts, etc.). See Section 6.
5. Revisions & Scope
- Each deliverable includes up to 2 rounds of revisions unless your Order states otherwise.
- Revisions must be requested within 7 days of delivery.
- Requests beyond the agreed scope (new pages, extra deliverables, a change of direction after approval) are considered additional work and may be quoted separately.
6. Content & Materials You Provide
- You confirm that any material you give us is owned by you or properly licensed, and that we may use it to perform the Services.
- You are solely responsible for the material you provide. If a third party claims your material infringes their rights, you agree to be responsible for that claim, not Alwize. We are not liable for content, claims, images, or information supplied or approved by you.
7. Ownership of Work
- Upon full payment, ownership of the final deliverables we create specifically for you transfers to you.
- Until full payment is received, all work remains the property of Alwize.
- We retain the right to use non-confidential finished work in our portfolio and marketing (e.g. showing a post we made for you), unless you ask us in writing not to.
- We retain ownership of our own underlying tools, templates, processes, and know-how.
8. Cancellation & Termination
Monthly subscriptions
- You may cancel at any time by giving 7 days’ written notice before your next billing date.
- Cancellation stops future billing; it does not refund the current or past billing periods.
- Work and access may end at the close of your paid period.
Per-project work
- If you cancel a project after work has begun, the upfront payment is non-refundable, and any work completed to date is payable.
By Alwize
- We may pause or end an engagement for non-payment, abusive behavior, or breach of these Terms, and you remain responsible for payment for work already performed.
9. Turnaround & Timelines
- Any dates we give are good-faith estimates, not guarantees.
- Timelines assume you provide materials and approvals promptly. Delays caused by you extend our timeline accordingly and are not grounds for a refund.
10. Third-Party Services
- Your project may rely on third-party services (e.g. domain registrars, hosting, social platforms, email tools, payment processors). Their fees, terms, and availability are your responsibility and outside our control. We are not liable for outages, changes, or issues caused by third-party providers.
11. Limitation of Liability
- We provide the Services on a “reasonable efforts” basis and do not guarantee specific results (such as sales, followers, rankings, or revenue).
- To the fullest extent permitted by law, Alwize’s total liability for any claim is limited to the amount you paid us for the Services in the 1 month before the claim arose.
- We are not liable for indirect, incidental, or consequential damages (such as lost profits or lost business).
12. Confidentiality
Both parties agree to keep each other’s non-public business information confidential and to use it only to perform or receive the Services.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Delaware, and both parties agree to that jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. For ongoing subscriptions, we’ll give you reasonable notice of material changes, and continued use after the change means you accept the updated Terms.
15. Entire Agreement
These Terms, together with your Order, are the entire agreement between you and Alwize and replace any prior discussions. If any part is found unenforceable, the rest still applies.
16. Alwize SMS Program Terms
By voluntarily opting in, you agree to receive conversational and transactional text messages from Alwize. Messages may include appointment confirmations, reminders, rescheduling updates, missed-call follow-ups, and customer-care communications.
Message frequency varies based on your interactions with Alwize. Message and data rates may apply. Consent to receive text messages is not a condition of purchasing any product or service.
Reply STOP to unsubscribe. After opting out, you may receive one final confirmation message. Reply HELP for assistance, or contact ask@getalwize.com. Carriers are not responsible for delayed or undelivered messages.
Your information is handled according to the Alwize Privacy Policy.
Agreement
By paying an invoice, purchasing a package, or beginning a project with Alwize, you confirm that you have read, understood, and agree to these Terms of Service.
Part 2 — Privacy Policy
This Privacy Policy explains what information Alwize LLC collects when you use getalwize.com or become a client, how we use it, and who we share it with. We keep this deliberately short and plain.
1. Information We Collect
Information you give us
- Contact form: your name, email address, business name, and whatever you write in your message.
- When you purchase: your name, email, billing details, and any information you enter at checkout (such as your business name or website).
- Project materials: logos, photos, copy, brand assets, and account access you choose to share with us so we can do the work.
Information collected automatically
- Standard technical data recorded by our hosting provider, such as IP address, browser type, and pages requested. This is ordinary server logging used for security and reliability.
- We do not run advertising or tracking cookies on this website, and we do not use analytics profiling to follow you around the internet.
2. Payment Information
- Payments are processed by Stripe. Your card details go directly to Stripe — we never see or store your full card number.
- We receive only what we need to run the business: your name, email, the amount paid, and the item purchased.
- Stripe handles your payment data under its own privacy policy and security standards.
3. How We Use Your Information
- To reply to your enquiry and answer questions.
- To deliver the Services you've purchased and communicate about your project.
- To process payments, issue invoices, and keep accounting and tax records.
- To send service-related messages (for example, an onboarding questionnaire or a delivery notice).
We do not sell, rent, or trade your personal information, and we don't add you to marketing lists without your consent.
4. Who We Share It With
We share information only with the service providers we need to operate, and only as far as necessary:
- Stripe — payment processing.
- Formspree — delivers contact-form submissions to our inbox.
- Vercel — website hosting.
- Google Fonts — serves the fonts used on this site.
- Professional advisers (such as an accountant) or authorities, where required by law.
SMS and Mobile Information
When you voluntarily provide your mobile phone number and opt in to receive text messages, Alwize may use that number to send appointment confirmations, reminders, rescheduling updates, missed-call follow-ups, and customer-care communications. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP, or request assistance by replying HELP.
Alwize does not sell, rent, or share mobile phone numbers, SMS consent records, or text-message opt-in data with third parties or affiliates for their marketing or promotional purposes. Mobile information may be shared only with service providers that help Alwize deliver text messages and operate its services, subject to confidentiality and data-protection obligations. SMS opt-in consent is not shared with third parties for their own marketing purposes.
5. Your Client Work
- We treat your non-public business information as confidential (see Section 12 of the Terms).
- As noted in the Terms, we may show finished, non-confidential work in our portfolio — tell us in writing if you'd prefer we didn't, and we won't.
6. How Long We Keep It
- Enquiries that don't become projects are kept only as long as useful, then deleted.
- Client and payment records are kept as long as needed for the working relationship and for legal, accounting, and tax obligations.
7. Your Rights
You may ask us to access, correct, or delete the personal information we hold about you, or to stop contacting you. Email ask@getalwize.com and we'll action it within a reasonable time. Some records (such as invoices) we're required to retain by law.
8. Security
We take reasonable steps to protect your information and rely on established providers (Stripe, Vercel) for payments and hosting. No method of transmission over the internet is completely secure, so we can't guarantee absolute security.
9. Children
Our Services are intended for businesses and adults. We do not knowingly collect personal information from children.
10. Changes to This Policy
We may update this Privacy Policy from time to time. The "last updated" date at the top of this page will always reflect the current version.
